What Is The Legal Definition Of Attempt?

Attempt is to act intentionally and purposefully in taking a substantial action towards the commission of a crime that fails to actually complete the crime. The mere plan to commit a crime is not an attempt. Getting someone else to commit the crime is a solicitation or conspiracy to commit a crime. Somewhere between planning a crime and committing it lays an attempt.

Attempted Murder

Attempted murder means taking intentional and substantial steps towards the unlawful killing of another human being.

An intentional, i.e. overt act is when the perpetrator has moved beyond the planning stage and begins to make substantial action in carrying out his intent to murder. This might include buying a firearm, and lying in wait in the victim's home until he arrives home so he can be shot.

If a person voluntarily stops or abandons his or her plans before attempting the substantial act towards murder, then that person is not guilty of attempted murder.

Penalties

Obviously attempted murder is a most serious crime, punished as a felony. Sentencing for attempted murder will vary according to the jurisdiction, with some states punishing it for half of what the penalty for a completed murder would carry.
