Termination of Sex Registration

A new law, Senate Bill (SB) 384, was passed and it affects those on the Sex Offender Registry. As a result, California’s lifetime sex offender registration transitioned to a tier-based scheme, which became effective on January 1, 2021. Starting on July 1, 2021, on or after their next birthday after this date, registrants who meet the minimum requirements can petition to terminate their sex registration requirement in the court that is in the county where they live.

There are three tiers of registration for adult registrants and two tiers of registration for juvenile registrants. The new law permits the registrant to petition either juvenile court or superior court for termination of their sex offender registration requirement on or after their next birthday after July 1, 2021, once their mandated minimum registration period expires.

The tiers are based on criteria that is outlined in Penal Code sections 290 through 290.024, et seq., the Sex Offender Registration Act.

Below is a list of the tiers for adult registrants:

Tier one: 10 years
Tier two: 20 years
Tier three: Lifetime

Below is a list of the tiers for juvenile registrants:

Tier one: 5 years
Tier two: 10 years

If you wish to know your tier designation, you can request this information from your local registering agency. If you believe your tier designation is incorrect, you should consult with an experienced attorney to have the error corrected.

In cases where an individual’s tier cannot be immediately determined, that person will be placed in a tier-to-be-determined category. Under these circumstances, the individual will be given credit for any period for which they register.

Even if you meet the mandatory minimum registration requirements, you must continue to register as a sex offender in accordance with the Act. However, after July 1, 2021 on or after your next birthday and following the expiration of the minimum mandated registration period, you may petition the court for termination.

Below is a list of reasons why you may be automatically ineligible for termination of sex registration:

You are in custody
You did not meet your minimum mandatory registration period
You are on probation, parole, or supervised release
You have charges against you that are pending and could potentially change your tier or lengthen the time to complete your tier
You are a Tier Three registrant
You did not fulfill the service and filing requirements
