A warrant of arrest is issued by a judge when a complaint has been made, and it directs law enforcement officers like the police to arrest a certain person and bring that person in to their custody before that person will be turn over to court. A law enforcement officer must show warrant of arrest before they will bring the suspect into their custody unless the following circumstances occur:
- An officer has reasonable ground to believe that a warrant for arrest has been issued in the state or in another jurisdiction.
- The accused committed or attempted to commit a crime in the presence of the law enforcement officer.
- The law enforcement officer has reasonable grounds to believe that a crime has been committed and that the accused are the person who did it.
It is important to know that when you are arrested you should not be detained in police custody for more than 24 hours without being charged, unless a judge or a magistrate gives permission. If you are accused of any crime, the maximum time that you may be detained in police custody is 96 hours. If you have been charged with a crime, then you must appear before a judge court. The police have the right to decide whether you can be released on bail, or whether you must remain in their custody until your court hearing.
