Who can Appeal?
A person who files an appeal is called an appellant. The appellant is the party who has lost in the battle of defending their entire claim in a lower court decision. In this case, they appeal to a higher court to have their case reviewed. This is actually done on the basis that the lower court judge has an error in the application of law, but the appellate may also appeal on the manner of court misconduct, or that a finding of fact was entirely unreasonable to make on the evidence.
How to appeal?
When lower court issued final judgment, the appellate should step in the process of filing, legally known as Notice of Appeal. A Notice of Appeal is filed with in the trial court and is designated to give notice to both the trial court and the other party for the case of accused intention to appeal.
Limitations to appeal
It is strictly crucial that the Notice of Appeal be filed within 10 days after the court decision is final or even more days in other states. Every state has a specific statute that governs the time frame for which a Notice of Appeal must be filed. If the accused fails to file a Notice of Appeal within the time permitted by statute, that individual will be forever banned from raising an appeal. From a clear view, the Notice of Appeal and the filing of that notice in the right time manner is considered jurisdictional. Moreover, if the Notice of Appeal is not filed before the time prescribed by law, this can cause the appellate court to never handle jurisdiction over the case.
If the Notice of Appeal is already filed, the case moves automatically to the appellate court. The appellate court will give the appealing party dead line for the filing of certain documents and materials with that court. It will include the appellate brief filed by the person making the appeal in the first instance.
